These terms and conditions ("Agreement") apply to your purchase of products and/or services offered on this web site by Intimonth, LLC. By placing your order, you accept and are bound to the terms and conditions of this Agreement. This Agreement shall apply unless you have a separate purchase agreement with Intimonth, LLC, in which case the separate agreement shall govern.
This agreement covers any and all internet sites that are owned and or operated by Intimonth, its subsidiaries or owners.

MEMBERSHIP
By joining Intimonth you are joining a monthly club that will send you products that you have ordered every month until you cancel. See cancellation. You agree that your payment method will be charged each month with the full amount. You also agree that you will not dispute or make a claim to your card payment company for any charges that are lawfully charged within the scope of this agreement.
SHIPPING AND HANDLING
All orders are shipped to you via U.S. Mail Priority Service or UPS.
Orders are shipped monthly on around the 15th of each month. New orders placed before the 10th of the month will be sent out the next shipping day.
Please note that we cannot ship to P.O. Boxes. Also, some or all of your items may ship separately.
Our shipping charges are based on the number of items in your order. Please see the chart below for details:
With your first order you have the choice of UPS Priority Shipping or our standard USPS Mail Priority Service. All orders after the first month’s order will be sent via USPS Mail.

CANCELATION
You may cancel your ongoing membership at any time by sending an email to customerservice@intimonth.com or by calling 1 866 665 8912. All cancellation requests must be received by the first day of the month. Cancellation requests received after the first of the month shall apply to the following month.
RETURNS POLICY
We want you to be happy with your purchase. Please make your selections carefully and contact us with any questions you may have prior to purchase. In general, lingerie items are not returnable unless defective or the wrong item was shipped. (See Size charts for assistance in making selections) If there is a problem, you must notify us within 14 days of receiving the order, and we will review return requests on a case by case basis. Any returns MUST be sent shipping pre-paid and be received within 30 days of purchase. Tracking is optional and lost packages will be the responsibility of the sender.
You must contact us to request a Return Authorization Number for all returns - include a short description of the reason for return. We will not accept returns without a Return Authorization Number. All authorized returns will be subjected to a 20% restocking fee.
Returned items must be in saleable condition or no refund will be sent. In the unlikely event that a package is damaged in transit, we will replace items that arrive in a damaged condition. To receive credit for such a package, you must report it to the post office that delivered it so that they can inspect the damage and verify it in writing. You will need to send the package in its entirety (including all packing materials and box) to receive a replacement.

As a valued customer, you can be confident in knowing that we do our best to protect your privacy. In fact, we have put many practices in place to make your privacy a high priority.

We reserve the right to change this Privacy Statement from time to time. We will post the changes on this page so you are always informed about what information we collect, how we use it, and under what circumstances we disclose it. Your continued use of Intimonth.com after a change has been posted will constitute your agreement to such change in the Privacy Statement.
Information Collection
When registering with intimonth.com or at Checkout, we ask you to provide personal information, such as your name, address, telephone number, credit card number, and e-mail address, by filling out and submitting a form. We will use this information to process and fulfill your orders and notify you of your order status if you request it. Once you've registered, you may click on Your Account to change or delete your personal information. You can also rest assured that we do not collect your name, e-mail address or any other personal information unless you provide it to us.
We may also gather information that helps us make improvements to our site or our products to help serve you better. For instance, we may do research to determine which areas of the site are visited most frequently. This information is collected and used in the aggregate form and is not gathered on an individual level; personal information, such as your name, credit card number, and e-mail address, is not included in the analysis. We may disclose such information in the aggregate to reputable third parties. We do not follow your browsing path outside of intimonth.com.
Sharing Information
We will divulge your private information if required to do so by law. If served with a subpoena, search warrant, or court order, we would provide the necessary information.
Cookies
A cookie is a small file stored on your computer by a Web site to give you a unique ID. Cookies help make it easier for you to use our site and identify you as a registered user -- and they help us provide you with the information you need.
A cookie generated by intimonth.com does not contain information about you. It only contains a numeric ID that, for example, lets you continue shopping where you left off with your last visit, without losing any of the items in your Shopping Cart.
E-Mail
After you've placed an order on our site, you will receive an e-mail confirmation -- if you've provided us with your e-mail address during checkout or as part of creating an account on the site.
You will not receive any additional emails, mailings or telephone calls promoting our products or special offers from the information provided to intimonth.com on the website. We use this information to process and fulfill your orders and notify you of your order status if you request it.
PAYMENT TERMS
Payment terms are within Intimonth’s sole discretion, and, unless otherwise agreed to by Intimonth, payment must be made at the time of purchase. Your order is subject to cancellation by Intimonth, at Intimonth’s sole discretion. Intimonth is not responsible for pricing, typographical, or other errors, in any offer by Intimonth and reserves the right to cancel any orders resulting from such errors.
LIMITATION OF LIABILITY
Intimonth does not accept liability beyond the remedies set forth herein, including but not limited to any liability for product not being available for use, lost profits, or loss of business. Except as expressly provided herein, Intimonth will not be liable for any consequential, special, indirect, or punitive damages, even if advised of the possibility of such damages, or for any claim by any third party. You agree that for any liability related to the purchase of product, Intimonth is not liable or responsible for any amount of damages above the amount invoiced for the applicable product. Notwithstanding anything in this agreement to the contrary, the remedies set forth in this Agreement shall apply even if such remedies fail their essential purpose.
BINDING ARBITRATION
Any claim, dispute, or controversy (whether in contract, tort, or otherwise, whether preexisting, present or future, and including statutory, common law, intentional tort and equitable claims) between you and Intimonth, LLC, its agents, employees, principals, successors, assigns, and/or affiliates arising from or relating to this Agreement, its interpretation, or the breach, termination or validity thereof, the relationships which result from this Agreement (including, to the full extent permitted by applicable law, relationships with third parties who are not signatories to this agreement), Intimonth’s advertising, or any related purchase shall be resolved exclusively and finally by binding arbitration administered by the National Arbitration Forum (NAF) under its code of procedure then in effect. The arbitration will be limited solely to the dispute or controversy between you and Intimonth. Any award of the arbitrator(s) shall be final and binding on each of the parties, and may be entered as a judgment in any court of competent jurisdiction. Intimonth will be responsible for paying any arbitration filing fees and fees required to obtain a hearing to the extent such fees exceed the amount of the filing fee for initiating a claim in the court of general jurisdiction in the state in which you reside. Each party shall pay for its own costs and attorneys' fees, if any. However, if any party prevails on a statutory claim that affords the prevailing party attorneys' fees, or if there is a written agreement providing for fees, the arbitrator may award reasonable fees to the prevailing party, under the standards for fee shifting provided by law.
GOVERNING LAW
This agreement and any sales there under shall be governed by the laws of the state of Delaware, without regard to conflicts of laws rules.
